The 37-year-old was arrested on April 8 after police responded to a call shortly after 2pmclaiming he was intoxicated at the Mammoth Mountain resort in Mammoth Lakes, California.
According to documents obtained by TMZ, Osment — who recently lost his home in LA’s devastating fires — was reportedly accompanied by ski patrol members when he was arrested at the popular skiing destination.
The actor was booked for public intoxication and possession of a controlled substance after being brought back to the police station.
Media reports say it is unclear what substance Osment allegedly had on him, as it was sent to the lab by police for testing.
He was reportedly released shortly after being booked.

Osment, who became a household name in the late 1990s and 2000s after starring with Bruce Willis in the hit horror-thriller, had reportedly been struggling since his home was burned to the ground in the devastating Altadena fire.
According to sources quoted by TMZ, although he had recently found a suitable replacement home, he was unable to get his insurance company to cover the cost.
This is not the first time that Osment has fallen foul of the law, having been arrested in 2006, when his car flipped over after he crashed into a brick pillar.
He was hospitalised with a broken rib and injured shoulder in the crash, and a month later, was charged with misdemeanour DUIs for driving under the influence of alcohol and for possession of marijuana.
He ultimately pleaded no contest to one count each of driving under the influence of alcohol and possession of marijuana.
Osment, who is also famous for performances in AI Artificial Intelligence, Forrest Gump and The Boys, was sentenced to three years of probation, along with 60 hours for an alcohol rehabilitation programme.
He was also required to attend Alcoholics Anonymous meetings for six months and to pay a $1,500 fine.
In February, Osment spoke about the difficulty of losing his home on the Mentor Buffet podcast.
Having lived in New York for 15 years, he moved to Hollywood in 2020 — just days before a state-wide lock down was ordered as Covid-19 hit.
“I had this very intense pandemic relationship that ended up going nowhere,” he reflected. “Then things started picking up after the worst of the pandemic,” he explained.
“And then we’ve had some political upheaval and this house that had been my refuge during the pandemic was completely destroyed in the Eaton Fire.”
At the time, Osment wrote on social media: “My heart would be so full every time I drove home. It was such a special place. I loved living there.”
In January, his younger sister, the Young Sheldon actor Emily Osment, revealed that their parents also lost their home in the Eaton Fire.
