Q A senior employee recently told us she is resigning her position and moving to another company. She is adamant that she won’t work her three-month notice period, and has openly defied us to bring her to court if necessary. Clearly the gamble is that my company won’t go to all the trouble and legal expense of forcing her to honour the terms of her contract. As she said: “What are you going to do about it?” I’m wondering should we take a stand and insist she serves the notice period, if only to deter anyone else from going the same route? Or should we just let her off?
A This is a frustrating situation for any business owner. It causes disruption, hampers workflow, and leads to uncertainty – particularly in an SME, where resources are limited and the process of finding a replacement can take time.
